Personal Injury

Injuries are an unfortunate part of life and for the most part no one is to blame. But if you or a loved one has been seriously injured due to another's negligence, one of the experienced attorneys at Marshall & Associates, PLLC. can help.

Fair compensation from the party who is responsible for your injury seldom happens because the insurance company lawyers primary goal is to protect their insured client - not to offer you, the victim of this negligence, a fair settlement.

The attorneys at Marshall & Associates are dedicated to fighting for you to achieve the best possible outcome for your case. Depending upon the severity of your injuries, you may be entitled to compensation for medical expenses, lost wages, pain and suffering, scarring or disfigurement,
emotional trauma, future medical treatment and rehabilitation or permanent disability.

We represent clients for a wide variety of different personal injuries, including, but not limited to the following:

  • Motor vehicle collisions
  • Product liability
  • Legal malpractice
  • Medical malpractice
  • Wrongful death
  • Nursing home abuse and neglect
  • Premises liability (injuries incurred from slipping or falling)

Probate Law

Probate is the legal process that occurs after someone dies, in order to transfer
the estate in an orderly, supervised and fair manner. It includes a number of
steps, such as:
  • Proving in court that the deceased party's will is valid
  • Identifying and performing an inventory of the deceased person's belonging and property
  • Having the belongings and property appraised
  • Payment of all debts and taxes
  • Distribution of the remaining property as the will directs
  • Appointment of a personal representative of the deceased

You can trust the experienced attorneys at Marshall & Associates PLLC. to provide you with guidance and advice during this sometimes quite complicated process.

We will assist with the preparation of legal and tax documents for the estate, organize and file the proper documents, assist with settling a complicated estate
and in the proper distribution of the estate according to the will, or absent a will, according to the law. We are a local family-owned law firm. Customer service is our priority. Our experienced attorneys provide clients with personal and timely attention.

Wills and Estate Planning

Wills and estate planning are similar legal procedures, but differ in many ways. A Last Will and Testament is the center of every estate plan, allowing you to distribute your assets, provide for your favorite charity or cause, and appoint guardians for your children.

Without a Last Will and Testament your property will be divided according
to the laws of your state, so if you wish to have control over how your property will be distributed after your death a Last Will and Testament
is required by law.

However, a will is only a portion of the process of estate planning. A power of attorney is essential in estate planning, allowing you to appoint a trusted family member or friend as an agent to manage your finances and medical decisions, if you are no longer capable of managing them yourself.  A Living Trust can allow you to transfer your assets to a separate legal entity, preventing your estate from going through the probate process, while a Living Will can specify what sorts of medical treatment you wish to receive in the event of your incapacitation due to illness or injury.

Estate planning is far more than preparing your Last Will and Testament.
It encompasses a variety of important legal areas, such as:
  • Creation of a Living Will
  • Power of Attorney
  • Preparation of the Last Will and Testament
  • Updating or adding codicils to your will
  • Creation of a Living Trust, to avoid the delays of probate
  • Creation of trusts to provide for your family
